Earlier this week, Judge Jon Tigar of the Northern District of California blocked the Trump-administration interim final rule that would, “categorically deny asylum to almost anyone entering the United States at the southern border if he or she did not first apply for asylum in Mexico or another third country.”

The asylum system that is being overwhelmed by new applicants, however asylum claimants may remain in the country legally while their claims are processed. The Trump administration is attempting to change the process with its interim final rule. Rather than granting illegal entrants the right to claim asylum regardless of how they enter the country, the Trump administration is attempting to force them to apply abroad.
